Terms of use for Shopeye

1. About Shopeye

Shopeye is operated and published by:

These terms of use apply to use of Shopeye's website, mobile app, browser extensions, user profile, webshop analyses, and other features that refer to the terms.

The website, app, browser extensions, and related features are collectively referred to as "Shopeye" or "the service".

2. Acceptance of the terms

By installing, creating an account with, or using Shopeye, you accept these terms of use and our privacy policy.

If you use Shopeye on behalf of a company or organization, you confirm that you have the authority to accept the terms on its behalf.

If you do not accept the terms, you must not use the service.

3. What Shopeye provides

Shopeye helps users investigate and assess webshops.

The service may, among other things:

  • find public business and contact information
  • investigate domain and security information
  • analyze trade, return, and delivery terms as well as payment methods
  • compare public reviews and mentions
  • identify potential dropshipping or risk signals
  • display a risk assessment or other overall assessment
  • explain the key signals behind the assessment
  • store previous webshop checks on the user's account

Shopeye's features and the signals included in the assessment may change over time.

4. Shopeye is a decision-support tool

Shopeye gives you information and an additional basis for your own assessment.

Shopeye does not make the purchase decision for you.

A high score or positive assessment is not a guarantee:

  • that the webshop is legitimate
  • that the webshop is financially stable
  • that you will receive the ordered item
  • that the item has the expected quality
  • that product images or descriptions are accurate
  • that reviews are accurate or representative
  • that business information is up to date
  • that the webshop complies with all laws and regulations
  • that you can recover your money in case of a dispute

Likewise, a low score, warning, or identified risk is not in itself a determination that a webshop has committed fraud or other unlawful activity.

Webshops, domains, and information can change quickly.

The result therefore reflects the assessment Shopeye could make based on the information available at the time of analysis.

You should still use common sense and, for example, verify:

  • who is behind the webshop
  • price and payment method
  • terms and conditions
  • return and delivery terms
  • contact options
  • whether the offer seems unusually good

5. Not professional advice

Shopeye does not provide legal, financial, tax, or other professional advice.

You should seek relevant professional advice if a decision has significant financial or legal implications.

Shopeye cannot replace assistance from, for example:

  • your bank
  • your card issuer
  • the police
  • European Consumer Centre
  • a consumer organization
  • a lawyer
  • a relevant authority

This applies in particular if you have already been exposed to fraud or have entered into a dispute with a webshop.

6. Relationship with webshops and third parties

Shopeye is not a seller, intermediary, or party to your purchase from a webshop.

When you visit or shop at a webshop:

  • you enter into the agreement directly with the webshop
  • the webshop's prices and terms apply
  • the webshop is responsible for the product
  • the webshop is responsible for the payment
  • the webshop is responsible for delivery
  • the webshop is responsible for customer service
  • your information is processed under the webshop's own privacy policy

Shopeye assumes no liability for a webshop's acts or omissions solely by displaying information about or linking to the webshop.

A webshop shown in Shopeye is not necessarily:

  • a Shopeye customer
  • a Shopeye partner
  • approved by Shopeye
  • certified by Shopeye
  • contacted by Shopeye

7. Information from third parties

Shopeye uses information from, among others:

  • public registers
  • domain registers
  • websites
  • review services
  • social media
  • public warning lists
  • other external sources

We aim to use relevant and trustworthy sources, but we do not manually verify all information.

We therefore cannot guarantee that third-party information is:

  • complete
  • up to date
  • free of errors
  • representative
  • available without interruption

An external source may change, remove, or limit access to information without notice. This may affect Shopeye's results.

Names, logos, and trademarks belong to their respective owners.

When shown in Shopeye, they are used only to identify the relevant webshop, company, service, or data source.

Display does not necessarily imply cooperation, sponsorship, or endorsement.

8. Errors and requests from webshops

We want information about webshops to be as accurate and fair as possible.

A webshop owner, company, or other affected person can contact us if they believe information is:

  • incorrect
  • outdated
  • misleading
  • linked to the wrong company
  • based on a technical error
  • based on information that has since changed

To the extent possible, the inquiry should state:

  • the relevant webshop
  • the specific information or assessment
  • why the information is considered incorrect
  • documentation for the requested correction

We investigate inquiries within a reasonable time.

We do not guarantee that a result, signal, or assessment will be changed.

A disagreement with Shopeye's assessment does not necessarily mean that the underlying information or analysis used is incorrect.

9. Browser extension access and automatic checks

To identify and analyze webshops, the browser extension may need technical permission to:

  • view the URL of the active page
  • examine relevant parts of the page's publicly displayed content
  • communicate with Shopeye's servers
  • show Shopeye's user interface on the page

The browser's description of a permission may be broader than Shopeye's actual use of it.

The browser extension automatically checks the active page to assess whether it is a webshop.

When a page is identified as a webshop, the extension may automatically:

  • clean the page URL
  • send the cleaned URL to Shopeye's servers
  • start a webshop check
  • fetch publicly available texts, images, and metadata
  • analyze other relevant public pages on the same domain
  • show Shopeye's button, panel, and result
  • store local settings
  • communicate with Shopeye's servers

An automatic check may therefore be performed without you first pressing the Shopeye button.

URL cleaning

The browser extension may briefly read the original URL on your device in order to clean it.

Before the URL is sent to Shopeye's servers or stored, Shopeye removes:

  • everything from and including the question mark ?
  • everything from and including the hash symbol #

This means that Shopeye, as a rule, only sends and stores:

  • protocol
  • domain
  • any port number
  • the page path

Example:

Original URL: https://webshop.dk/produkt/sko?campaign=sommer#anmeldelser

URL that Shopeye sends and stores: https://webshop.dk/produkt/sko

Query parameters, campaign information, and URL fragments are therefore, as a rule, not sent or stored.

The URL path may still contain product names, categories, product numbers, or other information that the webshop has placed in the address.

The cleaned URL may be stored and later used to revisit and analyze the publicly available page again.

You can manage or withdraw the browser extension's permissions through your browser or device settings.

The browser extension may stop functioning correctly if:

  • required permissions are removed
  • the browser changes
  • the operating system changes
  • a webshop changes its technical setup
  • external data sources change or become unavailable

10. Account and login

Certain features may require a user profile.

You are responsible for:

  • providing correct information
  • protecting access to your account and device
  • not sharing login details or security codes with others
  • notifying us in case of suspected misuse
  • keeping your email address up to date

You must not:

  • create an account using another person's identity
  • use an account you are not authorized to use
  • attempt to access another user's account
  • transfer or sell your account without our permission

Login via Apple, Google, or another external provider is also subject to that provider's terms.

11. Age

You must be at least 18 years old to independently enter into a paid agreement with Shopeye, unless applicable law permits otherwise.

Persons under 18 may use free features or create an account with the consent of a parent or guardian when such consent is necessary.

12. Permitted use

Shopeye is made available for personal and lawful use.

You must not:

  • attempt to gain unauthorized access to the service
  • attempt to gain access to other users' accounts
  • circumvent security, limitations, or access controls
  • overload the service with automated or unreasonably many requests
  • use bots, scraping, or automated access without written permission
  • copy or resell Shopeye's data or assessments
  • make Shopeye's data available as a competing service
  • reverse engineer the service
  • attempt to derive source code, models, or internal scoring rules, unless explicitly permitted by law
  • use Shopeye for harassment or extortion
  • use Shopeye for fake reviews or misleading publication
  • present Shopeye's assessments as legal or governmental decisions
  • manipulate data or try to artificially influence a webshop assessment
  • spread malware or other harmful content
  • use the service in violation of applicable law
  • infringe third-party rights

We may introduce reasonable limits for:

  • number of checks
  • number of automated requests
  • data volume
  • storage
  • API usage
  • other use of the service

Such limits may be introduced to protect the service's stability, security, and availability and to prevent misuse.

13. User content and feedback

If you send feedback, bug reports, suggestions, or other material to Shopeye, you retain ownership of your material.

You grant us a non-exclusive and royalty-free right to use the material to the extent necessary to:

  • process your inquiry
  • provide support
  • fix errors
  • improve Shopeye
  • develop new features

You may only send material you have the right to share.

Do not send:

  • confidential information
  • payment card information
  • passwords
  • security codes
  • sensitive personal data
  • material that infringes others' rights

14. Shopeye's intellectual property rights

Shopeye, including software, design, texts, graphics, database structure, scoring methods, analyses, and trademarks, belongs to BoK ApS or our licensors.

You receive a limited, personal, non-exclusive, and non-transferable right to use the service in accordance with these terms.

You do not obtain ownership of:

  • Shopeye
  • the source code
  • models
  • internal scoring rules
  • internal data sources
  • the database structure
  • other trade secrets

Public content from webshops belongs to the respective rights holders.

Shopeye's collection and analysis of such content does not transfer ownership to Shopeye.

15. Free and possible future paid features

Shopeye is currently made available free of charge.

Shopeye does not currently offer paid subscriptions or purchases in the service.

We may later introduce paid features or subscriptions.

Before you complete such a purchase, you will receive clear information about:

  • price and currency
  • what the purchase includes
  • subscription period
  • any automatic renewal
  • payment method
  • how to cancel the subscription
  • applicable withdrawal rights
  • applicable refund rules

Purchases through Apple App Store, Google Play, or another platform may also be subject to the platform's payment, cancellation, and refund terms.

Any new payment or subscription terms apply only to purchases made after the terms have been made available to the user.

Nothing in these terms limits rights you have under mandatory consumer law.

16. Beta and test features

Shopeye may provide access to beta, experimental, or test features.

Such features may:

  • be incomplete
  • contain errors
  • produce incorrect results
  • change without notice
  • have limited capacity
  • be removed again
  • be less stable than finished features
  • produce less accurate results than finished features

We recommend that you do not base significant financial or legal decisions solely on a beta or test feature.

17. Availability, maintenance, and changes

We strive to keep Shopeye available and secure, but we do not guarantee uninterrupted or error-free operation.

The service may be temporarily unavailable due to:

  • maintenance
  • updates
  • technical errors
  • security incidents
  • problems with hosting or data providers
  • changes in browsers
  • changes in operating systems
  • changes in app stores
  • changes on websites we analyze
  • changes in external data sources
  • circumstances beyond our reasonable control

We may change, add, or remove features to:

  • improve the service
  • maintain security
  • fix errors
  • comply with law
  • adapt to technical changes
  • adapt to changes in external data sources

For significant negative changes in any potential future paid service, we will provide the notice and options required by applicable law.

18. Suspension and account closure

You can stop using Shopeye and request deletion of your account.

We may limit, suspend, or close an account if:

  • you materially or repeatedly violate the terms
  • the account is used for misuse
  • the account is used for fraud or unlawful activities
  • the account is used to attack or overload the service
  • it is necessary to protect Shopeye
  • it is necessary to protect users or third parties
  • we are legally required to do so
  • a free account has been inactive for an extended period

We will normally notify you and allow you to remedy the issue unless immediate action is necessary for security or legal reasons.

Closing the account does not affect rights or obligations that have already arisen.

19. Liability

Shopeye strives to provide relevant, understandable, and up-to-date information.

However, an automated or AI-based assessment may be incorrect, outdated, or incomplete.

To the extent permitted by applicable law, BoK ApS is not liable for losses resulting from:

  • your decision to trade with a third party
  • your decision not to trade with a third party
  • a webshop's fraud
  • a webshop's insolvency
  • missing or delayed delivery
  • incorrect or defective goods
  • errors or deficiencies in third-party data
  • false or misleading reviews
  • changes that occurred after Shopeye's analysis
  • errors in automated or AI-based analyses
  • an external data source or platform being unavailable
  • unauthorized use of your account due to circumstances on your side
  • indirect loss
  • operational loss
  • loss of profit
  • loss of data

Any limitations of liability do not apply if the loss is caused by intentional misconduct or gross negligence on our part, or if liability cannot lawfully be limited.

Nothing in the terms limits your rights under mandatory Danish or European consumer law.

20. Privacy and personal data

Our processing of personal data is described in Shopeye's privacy policy.

The privacy policy describes, among other things:

  • how the browser extension identifies webshops
  • how URLs are cleaned
  • which information is sent and stored
  • how Shopeye uses Hetzner, OpenAI, and PostHog
  • how long information is stored
  • which rights the user has

The privacy policy is an independent description of our data processing and is not permission to process information beyond what follows from applicable law.

21. Changes to the terms of use

We may change the terms to reflect:

  • new or changed features
  • technical changes
  • security changes
  • changes in our business model
  • changes in legislation
  • changes in authority requirements
  • the need to make the terms clearer

The latest version will always be available on Shopeye's website.

For material changes, we provide notice through the service, by email, or in another appropriate way before the changes take effect.

Changes do not have retroactive effect.

22. Governing law and disputes

These terms are governed by Danish law.

If you are a consumer living in another EU or EEA country, you retain the protection granted by mandatory rules in your country of residence.

We encourage you to contact us first so we can try to resolve any disagreement.

Disputes that cannot be resolved amicably are handled by the competent courts under applicable rules.

As a general rule, a consumer may bring proceedings before the courts at their place of residence where mandatory rules allow it.
